- Definitions
“GTC” means these general terms and conditions of sale detailing the conditions of use of the Site and the terms and conditions for placing Orders;
“Customer” means any natural or legal person with or without a valid Account and/or placing one or more Orders;
“Order(s)” means the Customer’s firm order(s) for the acquisition of one or more Product(s) available on the Site;
“Account” means a valid account of a User allowing the placing of Orders;
“Content” means the content (texts, sounds, videos) posted online on the Site by STATEMENT and belonging to it;
“Personal Data” means any information relating to an identified or identifiable natural person, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, an online identifier, or to one or more specific elements specific to his or her physical, physiological, genetic, psychological, economic, cultural or social identity;
“Privacy Policy” means the document established by STATEMENT presenting the processing of Users’ Personal Data and defining their corresponding rights ;
“Product(s)” means the jewelry item(s) and more generally, the products offered for sale by STATEMENT via the Site. All Products offered for sale on the Site are new;
“Site” means the STATEMENT online store accessible from any terminal (including mobile and tablet) at the address www.statement.paris from which Users can place an Order;
“User” means any person, Customer or not, who visits or consults the Site.
- Presentation of the website www.statement.paris
The Site is published by STATEMENT, a simplified joint-stock company with capital of €20,000 registered with the Paris Trade and Companies Register under number 833 524 689, whose registered office is located at 21, rue de Marignan 75008 Paris (France) and represented by its President AH CONSULTING, herself represented by its Manager, Mrs. Amélie HUYNH (“ STATEMENT ”).
The General Terms and Conditions are accepted by Customers when placing an Order and are available to Users at any time from the Site.
By accessing the Site, Users acknowledge having read and understood the T&Cs and agree to be bound by them.
STATEMENT reserves the right at its sole discretion to modify the T&Cs at any time; the applicable T&Cs are those that the Customer accepted when placing the Order.
- Placing Orders from the Site
Orders are made from the Site.
3.1. Creation of an Account or use of the Site as a guest without creating an Account
To place an Order, the User can create an Account by choosing a password or use the Site as a guest without having an Account.
If an Account is created, the User will receive an email from STATEMENT confirming their registration.
If the User already has an Account, they will simply need to log in using their password. Users' passwords are strictly personal and confidential. STATEMENT recommends that Users change their passwords regularly and choose complex passwords that include letters, numbers, and specific characters. Users should not share their passwords with others. Users are responsible for the loss or theft of their passwords if it is proven that they have committed a fault attributable to them. In this case, Users must inform STATEMENT without delay.
For more information regarding the Personal Data processed by STATEMENT, the User is invited to consult the Confidentiality Policy .
3.2. Selection of Products and addition of Products to the Customer’s basket
The User may select the Products of their choice provided that they are available for sale online and in the desired quantity.
The total price including all taxes, as well as the amount of said taxes, will be displayed on the Site. The Customer can consult any delivery costs, delivery times and return procedures in the “ Deliveries and Returns ” menu.
To add a Product to their basket, the User must:
- choose the Product, the size if applicable, and the desired number;
- click on the “add to cart” button.
Each new addition to the basket will be mentioned on the Site by the appearance of the number of items in the basket.
At any time, the User may consult the summary of the Product(s) selected and which are in their basket, continue the selection by continuing their purchases from the Site or complete the Order by proceeding to payment.
3.3. Payment to complete the Order
Before finalizing the Order and paying, the User is directed to a page of the Site allowing him to consult the details of the selected Product(s) which he can modify.
Before proceeding to payment, the User must provide billing information and delivery information and choose the shipping method.
The User will be informed of the estimated delivery time of the Products.
Before payment, the User must carefully check his Order, confirm the billing and delivery information and validate the General Terms and Conditions.
Payment for the Products may be made by any means of payment offered via the Site, in particular by bank card (including MasterCard, Visa and American Express) and via the Stripe platform.
If you pay for your order in installments, you accept Alma's general customer conditions as well as Alma's specific conditions for STATEMENT customers .
The Order will only be processed by STATEMENT once payment has been made by the Customer.
3.4. Confirmation by STATEMENT of the Order
After placing the Order, the Customer will be able to access a summary of the Order on the Site from their Account, including the order number. This summary will be sent to the Customer in a confirmation email containing all the elements of the sales contract entered into between the Parties.
This information constitutes proof of the nature, content and date of the Order placed by the Customer and is authentic, which the Customer expressly accepts.
3.5. Delivery of the Products to the address provided by the Customer
The Products will be delivered, at the Customer's choice, to the address provided, to the STATEMENT showroom located at 21, rue de Marignan 75008 Paris (France) or any address communicated for this purpose on the Site, when placing an Order.
The Customer can follow the progress of their delivery on the Site by logging into the Account.
- Purchasing Conditions & Customer Guarantees
To place an Order, the Customer, if he or she is a natural person, must be an adult (or failing that, be a minor over the age of sixteen and place the Order with his or her legal representatives) and be legally capable of entering into a contract.
If the Order is made on behalf of a legal entity, the Customer declares and guarantees that he or she is authorized to place the Order on behalf of the legal entity. In this case, the Customer undertakes to purchase the Products for personal use and not for resale to third parties.
The Customer guarantees that the Products will not be delivered, sold or distributed for commercial purposes.
Any Order made in violation of this article will be null and void.
By validating an Order, the Customer submits to STATEMENT an offer to purchase the Products placed in their shopping cart. STATEMENT reserves the right to refuse, cancel and terminate Orders at any time if circumstances make it legitimate, particularly in the event of a violation of the General Terms and Conditions or attempted fraud.
- Product Information & Availability of Products offered on the Site
The Products offered for sale are those which appear on the Site and which can be the subject of an Order, except in the event of exceptional unavailability or right of withdrawal exercised by STATEMENT.
Sales offers, including promotional offers, are valid as long as they are advertised on the Site. Any promotional offer not originating from the Site cannot be validly opposed to STATEMENT.
STATEMENT makes every effort to comply with the requirements of Article L.111-1 of the French Consumer Code by posting the essential characteristics of the Products online. The photographs of the Products are provided for illustrative purposes and are not contractually binding.
The User is invited to consult the description of each Product to know its essential characteristics. The Products include the hallmarks used to certify the quality of the metals used by STATEMENT.
In the event of exceptional unavailability of the ordered Product, STATEMENT will inform the Customer as soon as possible and the Customer may change their choice or cancel the Order. In all cases, STATEMENT will offer the Customer a Product of equivalent quality and price or alert them by email if the chosen Product becomes available in the future.
- Product Prices & Delivery Costs
The prices of the Products are fixed. The Products will be invoiced on the basis of the rate in effect at the time of confirmation of the Order.
Prices are in euros, net, all taxes included.
Packaging and shipping costs can be viewed on the Site and will be communicated to the Customer before validation of the Order.
Under no circumstances will the prices appearing on the Site when an Order is placed bind STATEMENT for future orders. Product prices may be modified at any time by STATEMENT, without notice and except for a current Order.
- Payment for products & Billing
The Customer must pay for their Order in full by bank card via technical service providers such as Stripe or by any means offered by STATEMENT.
To proceed with payment, the Customer will provide their payment details to the technical service provider responsible for online payment processing. Transactions made by credit card are secure.
In the event of refusal of payment authorization, STATEMENT will suspend the Order and any possible delivery and the Customer must directly contact the issuer of the payment card responsible for such refusal.
The Products ordered remain the property of STATEMENT until full payment of their price. In the event of a payment incident, the Customer undertakes to return the Product(s) received to STATEMENT upon first request. On the effective delivery date, the risks (including loss, theft or damage) concerning the Products delivered are fully assumed by the Customer.
All invoices are dated the day the Order is placed. The invoice will be included in the package containing the Products.
- Order Dispatch & Order Delivery
The Products will be delivered, at the Customer's choice, to the delivery address provided when placing the Order, to the STATEMENT showroom located at 21, rue de Marignan 75008 Paris (France) or any address provided for this purpose on the Site.
Unless otherwise stated on the Site, STATEMENT may ship the Products to the following countries in mainland France (including Corsica), to all countries of the European Union and internationally under the conditions specified on the Site.
Delivery times are displayed on the Site prior to placing the Order. Unless otherwise stated, they vary:
- for “ priority ” deliveries: one to two working days excluding public holidays after the Order in France and the European Union,
- for “ standard ” deliveries: two to five working days excluding public holidays after the Order in France and the European Union, and
- for international deliveries: five to eight working days excluding public holidays after the Order (subject to delays due to Customs).
The above delivery times are given as an indication and correspond to those usually observed.
In the event of delivery outside mainland France, standard delivery is free, as are any returns.
For deliveries by courier within Paris, the delivery costs of the Products are covered by STATEMENT.
For international countries, the price displayed is exclusive of VAT. Standard delivery is free and customs fees are included.
It is the customer's responsibility to check upon receipt that the Products have not been damaged during transport and to immediately notify STATEMENT if this is the case.
No dispute relating to the delivery itself is possible if the package appears to have been delivered, the carrier's computer system or the signature of the delivery slip being proof.
STATEMENT will be exonerated from all or part of its liability for any delay or failure to perform by providing proof that it is attributable either to the Customer, or to the unforeseeable and insurmountable act of a third party to the contract, or to a case of force majeure as provided for by Article L.121-19-4 of the Consumer Code.
- Right of withdrawal for non-professional Customers
In accordance with the legal provisions in force, the non-professional Customer benefits from a right of withdrawal which he can exercise without having to justify a reason within fourteen (14) days from receipt of the Products.
If the Order relates to several Products, the withdrawal period starts from receipt of the last Product.
To exercise the right of withdrawal, the Customer must return the withdrawal form reproduced below or a written declaration unambiguously expressing his or her wish to withdraw to STATEMENT at the following address: STATEMENT withdrawal service 21, rue de Marignan 75008 Paris (France) or any address provided for this purpose on the Site.
The Products must be returned by the Customer within fourteen (14) days following communication of his decision to withdraw.
In the event of exercising the right of withdrawal within the aforementioned period, and in accordance with the provisions of Article L121-20-1 of the Consumer Code, the amount of the Order as well as any delivery costs will be reimbursed to the Customer, with the exception of any customs clearance costs.
Return costs will be borne by:
- for Orders placed and received in mainland France (including Corsica) or in one of the countries of the European Union: by STATEMENT which will send, after having been informed of the exercise of the right of withdrawal, to the Customer the information allowing the return of the Products;
- for Orders placed and received internationally: by the CUSTOMER.
The Products must be returned to the following address: STATEMENT 21, rue de Marignan 75008 Paris (France), or any address provided for this purpose on the Site, in perfect condition for resale (unworn, undamaged, undamaged or soiled), in their original packaging, accompanied by the certificate of authenticity, any accessories (except gift wrapping) and a copy of the invoice.
If the return is accepted after verification of the condition of the Product(s), the refund will be made by STATEMENT by the same means of payment as that used by the Customer at the latest within fourteen (14) days from receipt of the Product(s) by STATEMENT or from transmission of proof of shipment of the Product(s).

- Lack of conformity and hidden defects of the Products
The provisions of this article are without prejudice to the right of withdrawal provided for in article IX.
In accordance with the legal provisions in force, the Products benefit from the legal guarantees of conformity provided for by articles L.211-4 et seq. of the Consumer Code and hidden defects provided for by articles 1641 et seq. of the Civil Code.
The Customer has a period of two (2) years from delivery of the Products to act under the legal guarantee of conformity or in the event of hidden defects.
The Products must be returned, in accordance with the return procedure mentioned in Article IX, by writing to the address info@statement.paris in perfect condition for resale (unworn, undamaged, undamaged or soiled, other than the alleged defect), in their original packaging, accompanied by any accessories (except gift wrapping) and a copy of the invoice.
If the return is accepted, the Customer may request the repair or replacement of the Product, or if these are impossible, the cancellation of the sale or a reduction in the sale price for Products affected by hidden defects.
The return costs will be borne by STATEMENT, which will send the Customer the information enabling the return of the Products.
- Responsibilities and guarantees
The User is solely responsible for his Account, which allows him to manage his Orders (current or past), the Personal Data contained therein and his password.
The Customer is fully responsible for any payment incident. The Customer guarantees to be fully vested with the rights to pay the entirety of any Order.
STATEMENT, subject to an obligation of means, will not be responsible for:
- any stock shortages that may occur during an Order;
- the partial or total non-performance of its obligations or any delay in the performance of these obligations, if this non-performance or delay was caused by the occurrence of unforeseeable, irresistible and external events or if this non-performance or poor performance is attributable to the Users or is the unforeseeable and insurmountable act of a third party;
- difficulties related to the internet network and difficulties related to hosting and more generally any technical disruption likely to occur on the Site.
Access to the Site may be interrupted for technical reasons without STATEMENT being held liable in this regard.
If STATEMENT's liability should be incurred for any reason whatsoever, the maximum amount to which STATEMENT could be ordered may in no case exceed the amount of the Order.

- Intellectual Property
The Site is an intellectual work protected by intellectual property law. The Site is the exclusive property of STATEMENT.
Any reproduction or representation, in whole or in part, of the Site, or of any of its elements, on any medium whatsoever, for other purposes, and in particular commercial purposes, is expressly prohibited.
STATEMENT does not control the content, advertising, products or services available on or from sites linked to its Site.
- Account Deletion
The Client may request STATEMENT to delete their Account by writing to info@statement.paris .
The deletion of the Account will be effective two months after receipt of the request by STATEMENT and except for an Order in progress.
The Customer must retrieve the invoices for their Orders before deleting their Account.
- Force Majeure
Neither the Customer nor STATEMENT shall be liable for any failure or delay in performance caused by causes beyond its reasonable control, such as fire, flood, epidemic, famine, earthquake, hurricane and other natural disasters or the regulation or acts of any authority or civil or military act of any self-regulatory authority, war, terrorism, riots, civil unrest, sabotage, theft or other criminal acts of third parties.
- Final provisions
The T&Cs, the Privacy Policy and the terms of the Order constitute the entire agreement between Users and STATEMENT.
STATEMENT's failure to enforce any of the provisions of the T&Cs cannot be considered or interpreted as a waiver.
If one or more provisions of the General Terms and Conditions are declared invalid, the others shall retain their full force and effect. In this case, the parties shall, if possible, replace this invalidated provision with a valid provision corresponding to the spirit and purpose of the General Terms and Conditions.
The T&Cs are governed by French law. The French version of the T&Cs prevails over any other version.
In the event of a dispute, the non-professional Client has the option of resorting to mediation or any other alternative dispute resolution method.
WITHIN THE LIMITS PROVIDED BY APPLICABLE LAW, ANY DISPUTE RELATING TO THE VALIDITY, INTERPRETATION OR EXECUTION OF THE GTC WILL BE SUBJECT TO THE EXCLUSIVE JURISDICTION OF THE COURTS WITHIN THE JURISDICTION OF THE PARIS COURT OF APPEAL, INCLUDING IN THE EVENT OF AN APPEAL ON THIRD PARTY OR MULTIPLE DEFENDANTS.
